Adjudication in Construction Contracts
By: Redmond, John
Published by: Wiley-Blackwell

Adjudication was introduced in construction contracts as a requirement of the Housing Grants, Construction and Regeneration Act in 1998 to tackle the large number of disputes which dog most projects. Provisions for adjudication are now included in all standard construction forms and are implied into all construction contracts that do not expressly include them. When adjudication was first launched there were enormous uncertainties about how it would work in practice, and books published to coincide with the launch could only speculate on this. This new guide, written by a construction lawyer and experienced adjudicator, is the first to explain how adjudication is actually working in practice. It covers all the major court decisions which have clarified enforcement, adjudicator errors and problems such as definition of construction contracts, jurisdiction, insolvency, natural justice and human rights. It also deals with the complex requirements of the legislation regarding payment terms. This will provide a highly readable, but authoritative guide for all involved in adjudications, whether contracts directors, construction consultants, lawyers or adjudicators. more...

Antitrust Religion
By: Rockefeller, Edwin S.
Published by: Cato Institute

Many successful American businesses have been accused of anti-competitive practices. Drawing on 50 years of experience with U.S. antitrust laws, attorney and author Edwin S. Rockefeller sheds light on why lawmakers, bureaucrats, academics, and journalists use arbitrary and irrational laws and enforcement mechanisms to punish capitalists rather than promote competition. The Antitrust Religion argues that everything most people know about antitrust is wrong. more...

The Application of EC Law in Arbitration Proceedings
By: Shelkoplyas, N
Published by: Europa Law Publishing

For decades, the worlds of European law and international commercial arbitration have coexisted as distant planets whose orbits hardly ever intersected. However, the dynamics of EC law and arbitration have been similar: both have been steadily expanding and gaining in scope, influence and ambition. The relationship between the two has in recent years become complex and intricate as the Eco Swiss judgement of the European Court of Justice demonstrated. The author focuses on finding and analysing the origin and causes of the tension in the relationship between EC law and arbitration. Different methodological approaches to the problem of the relationship between EC law and arbitration inspired by European law or arbitration practice are analysed. Both the grounds of application of EC law in arbitration proceedings and various mechanisms at the national and Community level safeguarding its application are extensively considered. On this basis, the author reflects on how the contradiction between, on the one hand, requirements of effective and uniform application of law stemming from EC law and, on the other hand, national principles of judicial non-interference in arbitration and the finality of the arbitral awards, which exclude judicial review of the awards on the grounds of legal and factual errors, should be resolved. The ultimate aim of this book is to open up the problem area to an audience with diverse specialist knowledge: arbitration practitioners, lawyers, judges, and anyone with an interest in the influence of EC law on arbitration and private law in general. more...

Banking Regulation and World Trade Law
By: Panourgias, Lazaros E.
Published by: Hart Publishing, Ltd

Banking Regulation and World Trade Law concerns the legal aspects of the interaction between banking regulation and international trade in financial services. The author studies the internal banking market of the European Union, the liberalisation of financial services trade in the World Trade Organization, the accords of the Basel Committee on Banking Supervision and the European Central Bank. The book focuses on the balancing between banking regulation and international trade law. It discusses discrimination and proportionality in national banking regulation, the allocation of prudential regulation and supervision between home and host country, and international financial law-making. The author questions decentralised/nation-based banking regulation and supervision as a foundation for a sustainable liberalisation of international trade in financial services. The book considers various reforms of the international financial architecture, such as the incorporation of the Basel processes and accords into the WTO system, and the setting up of new international institutions by building on the Basel Committees or the IMF structures. The role of central banking in designing the international financial architecture is also explored: the book reviews the ECB's competence over foreign exchange policy and its function as lender of last resort, and treats price stability, banking soundness and representation as critical concepts. The analysis also reveals that the concept of 'prudential', despite its extensive use in banking regulation, has not been defined with adequate precision. In seeking to delineate the interface between international economic law and banking regulation, Dr Panourgias builds on the rich European scholarship on institutional financial issues and the US interdisciplinary approach to world trade law. He also entertains the notion of international financial law as a distinct field. The book will be of particular interest to those concerned with financial la more...
