Band die eben erwAhnten BankgeschAfte zusammen, wobei auch das Kontokorrent als typische Form der Abwicklung von Konten im Allgemeinen und in seiner besonderen Ausformung bei Girokonten in einem eigenen Kapitel behandelt wird. Das Kapitel A1/4ber das Konto wurde wieder von Univ.-Prof. Dr. Iro, diesmal unter Mitarbeit von Dr. Zepke, bearbeitet. Die Abschnitte A1/4ber das Kontokorrent und das EinlagengeschAft hat in dieser Auflage o.Univ.-Prof. Dr. Apathy, jenen A1/4ber das SafegeschAft wie bisher o.Univ.-Prof. i.R. Dr. Koziol verfasst.

The Application of EC Law in Arbitration Proceedings

For decades, the worlds of European law and international commercial arbitration have coexisted as distant planets whose orbits hardly ever intersected. However, the dynamics of EC law and arbitration have been similar: both have been steadily expanding and gaining in scope, influence and ambition. The relationship between the two has in recent years become complex and intricate as the Eco Swiss judgement of the European Court of Justice demonstrated. The author focuses on finding and analysing the origin and causes of the tension in the relationship between EC law and arbitration. Different methodological approaches to the problem of the relationship between EC law and arbitration inspired by European law or arbitration practice are analysed. Both the grounds of application of EC law in arbitration proceedings and various mechanisms at the national and Community level safeguarding its application are extensively considered. On this basis, the author reflects on how the contradiction between, on the one hand, requirements of effective and uniform application of law stemming from EC law and, on the other hand, national principles of judicial non-interference in arbitration and the finality of the arbitral awards, which exclude judicial review of the awards on the grounds of legal and factual errors, should be resolved. The ultimate aim of this book is to open up the problem area to an audience with diverse specialist knowledge: arbitration practitioners, lawyers, judges, and anyone with an interest in the influence of EC law on arbitration and private law in general.

Civil jury behavior has consequences not only for litigants and attorneys (and the jurors themselves), but also for society as a whole. It goes without saying that one of the jury??'s major goals, if not the major goal, is to mete out justice. In civil cases, justice is served primarily through the awarding of compensatory (to provide restitution for injury) and punitive damages (to provide punishment for wrongdoing). However, ongoing policy debates regarding tort reform have led both legal analysts and empirical researchers to reevaluate the civil jury??'s role in meting out civil justice. Some reform advocates have called for removing certain types of cases (e.g., highly technical ones relying exclusively on expert testimony, such as malpractice or antitrust litigation) or certain types of judgments (e.g., punitive damages) from the jury??'s purview; yet much of the policy debate has proceeded in the relative absence of data on what the effects of such reforms would be. For example, a number of states have enacted reforms regarding punitive damages and damages for pain and suffering, such as caps or ratio scales, on the assumption that these measures will yield more just outcomes. In this context, "more just" can mean a variety of things, but centers largely on greater predictability of awards, less variability, and a closer adherence of awards to legally relevant factors (e.g., the severity of the harm in compensatory damages, and the degree of reprehensibility in punitive damages). A number of post-reform studies have demonstrated that contrary to expectation, tort reform may not have the desired effects. In addressing these issues, the present volume will take an empiricalapproach, relying on archival and experimental data. It will be at the vanguard of the debate and will provide information relevant to the state and national civil justice systems.
